Shoffner was already charged with federal bribery and extortion charges but on Thursday, prosecutors also added on several counts of mail fraud.
A motion filed by Chuck Banks today claims that the Feb. 6 indictment charges Shoffner with "far different federal crimes than were originally alleged."
He calls the timing of the new charges "disappointing and unreasonable in it's burden for Ms. Shoffner's efforts to defend herself."
That's why he's asking a judge to separate those charges, saying they need their own trial.
As it stands now, Shoffner's trial on all charges is set for early March.
