Tracy Morgan Suing Walmart After NJ Truck Accident

NBC-- Comedian Tracy Morgan is suing Walmart for negligence over last month's accident.

The accident, on the New Jersey turnpike seriously injured Morgan and killed fellow comedian Jimmy Mack. The lawsuit claims Walmart should have known one of its tractor trailer drivers had been awake for over 24 hours when he slammed into Morgan's limousine.

Morgan, known for his roles on Saturday Night Live and 30 Rock is still recovering. The other three people in the limo are also listed in the lawsuit.

Walmart released a statement saying:

"This has been a terrible tragedy. We wish Mr. Morgan, Mr. Fuqua Jr., and Mr. Millea full recoveries. Our thoughts continue to go out to them, their families and friends, as well as to the families and friends of everyone involved, including Mr. McNair who lost his life. We are deeply sorry that one of our trucks was involved. As we’ve said, we’re cooperating fully in the ongoing investigation. We know it will take some time to resolve all of the remaining issues as a result of the accident, but we’re committed to doing the right thing for all involved."
