Judge Dismisses Rogers Lawsuit Against Bentonville over Land

BENTON COUNTY - A judge dismissed a lawsuit the city of Rogers filed against Bentonville. It's all apart of the land battle between Rogers, Bentonville and Cave Springs. 

The decision lands right before Rogers' Tuesday special election. Early voting is already underway.

But for the property owners, who annexed in Bentonville, Thursday was seen as a small victory.

"This thing's kind of been like a rollercoaster. Up and Down," said Jerry Orr who now lives in Bentonville.

The 39 property owners in the middle of the land dispute have an answer about what town they're living in. For now, it's Bentonville.

Benton County judge Brad Karren dismissed Rogers' lawsuit.

"I would like to say welcome to the 39 property owners who wanted to be a part of our city, and have been delayed," said Bentonville Mayor Bob McCaslin.

"I realize several of them were frustrated. So now I'm happy for them, because I know it removes some anxiety on their part," said McCaslin.

Even though the lawsuit was dismissed, Rogers said the election for the land is still on.

However, those who petitioned to annex into Bentonville are no longer allowed to vote since they're technically now Bentonville residents. 

"We think the whole thing is wrong, because in this country we are supposedly free and have a right to choose," said Orr.

Orr, who's lived on his property for 16 years and annexed in Bentonville, already early voted, so now his ballot will be take

"Rogers can't understand that we should have the freedom to elect what city our property is in." n out," said Orr.

In the end, most of the property owners tell us they never wanted to be annexed by anyone.

 "Rather than being told where to go, they would choose..and that's what they did..they choose Bentonville," said McCaslin.

Orr said he'll keep fighting till the end.

"It is not a life and death process, thank goodness. So we'll live through it, and we'll come out on the other side," said Orr.

Rogers released a statement saying, "In light of the ruling by the court, Bentonville's annexation complicates city planning and provision of services to this area. We're reassessing what's best for the City of Rogers and the region as a whole."
