Court Rules in Favor of Fort Smith Public Schools in FOIA Lawsuit

The Sebastian County Circuit Court’s ruling in favor of Fort Smith Public Schools was upheld by the Court of Appeals in a FOIA lawsuit.

FOIA stands for Freedom of Information Act.

The lawsuit accused Fort Smith Public Schools and the Fort Smith School Board of violating FOIA regulations when they held a meeting to change the Southside High School Rebel mascot and Dixie fight song without a separate notice. The court ruled in favor of the schools saying in part that a meeting notice was given prior to the meeting and the statutory requirement were met.

The school board originally was set to meet about the superintendent, and while waiting for a school board member to show up, held a Committee meeting on the school mascot and fight song.

The court ruled that original meeting notice was sufficient for both.
